In these Terms and Conditions we have used “we”, “us”, and “our” to refer to IR Imports

Limited T/a Endless Flooring.

1. A deposit of 50% is required and must be paid in full to us before we can commence work

and/or order any materials. Any supply and lay job will require a 50% deposit, work invoiced

once the laying is completed and a final invoice will follow once the sanding and coating is

completed if applicable.

2. Payment is due 5 working days following the date of invoices which shall be issued as

payment claims (“the Due Date”).

3. Any payment schedules under the Construction Contracts Act 2002 must be issued to us by

email to [email protected] and are due within 5 working days of the date of our

payment claim. You agree that we may render invoices as payment claims pursuant to the

Construction Contracts Act 2002 by way of email.

4. If you do not make payment on the Due Date, you shall be liable to pay:

a. Default interest at the rate of 2.5% per month, which shall accrue on a daily basis on the

total amount outstanding from the Due Date to the date of payment in full; and

b. Any legal costs on a solicitor/client basis that we incur incidental to the enforcement or

attempted enforcement of our rights, remedies and powers under these Terms and Conditions.

5. If this quotation is not signed then you will be deemed by your conduct to have accepted

these Terms and Conditions if you ask us verbally or in writing to commence works at your

property and/or you pay the required deposit.

6. All workmanship carries a 12 month warranty.

7. All coatings carry the manufacturer’s warranty.

8. Satisfaction of stain colours, tints and polyurethane coating finishes cannot be guaranteed

due to outward factors. We will do a test patch on the floor before application at the customers

request, otherwise the customer accepts the finish and/or colour as stated at the time of

quoting.

9. We cannot guarantee workmanship where there has been access within the time allocated to

complete this job and up to three days after the last coat is applied, by any tradesmen,

personnel, pets, animals, or any other unauthorised persons or acts of nature that has affected

the coating process.

10. We cannot guarantee scratch free floors if a sand only job is accepted due to the visibility

of fine scratches that are addressed at the coating stage.

11. One weeks notice is required for cancellation of a previously booked job. Short notice

cancellation will result in a $250 + GST fee being charged to cover loss of income.

12. The customer agrees to secure any personal items, pets or animals that may inhibit the

ability of Endless Flooring to fulfill the services requested by the customer.
